Welcome to AllSail. By accessing or using our platform, you agree to be bound by these Terms of Service. Please read them carefully before using our services.

1. Definitions

In these Terms of Service, the following terms have the meanings set out below:

Platform: The AllSail website, mobile applications, and all related services operated by All Sail LLC.
User: Any person who accesses or uses the Platform, including Guests and Partners.
Guest: A User who searches for, inquires about, or books a boat rental through the Platform.
Partner: A User who lists one or more boats for rental on the Platform.
Booking: A confirmed reservation of a boat rental made through the Platform.
Commission: The fee charged by AllSail on each Booking, currently set at 20% inclusive of the total booking price.
Charter: The rental period during which the Guest uses the boat as agreed in the Booking.

2. Account Registration and Use

To use certain features of the Platform, you must create an account. When creating an account, you agree to:

Provide accurate, current, and complete information during the registration process.
Maintain and update your account information to keep it accurate and current.
Maintain the security and confidentiality of your login credentials.
Accept responsibility for all activities that occur under your account.
Notify AllSail immediately of any unauthorized use of your account.

AllSail reserves the right to suspend or terminate any account that violates these Terms or our Community Guidelines.

3. Booking and Payment Terms

All bookings made through the Platform are subject to the following terms:

Bookings are subject to availability and acceptance by the Partner.
The total price displayed at checkout includes the boat rental fee, any selected extras, and all applicable taxes. No additional tax is charged separately.
Payment is processed securely through our payment provider, Stripe. AllSail does not store your payment card details.
AllSail charges an inclusive commission on each booking. The Guest pays the total price, and the Partner receives the total minus the commission.
Prices are displayed in the currency of the boat listing. Currency conversion rates are approximate and may differ from your bank's rate.

4. Cancellation and Refund Policy

Cancellation terms depend on the cancellation tier selected by the Partner for each boat listing. Please refer to our dedicated Cancellation Policy page for detailed information about each tier:

Flexible: Full refund if cancelled more than 48 hours before departure. Default for hourly rentals.
Moderate: Full refund if cancelled more than 14 days before departure. Default for daily rentals.
Strict: Full refund if cancelled more than 30 days before departure. Default for weekly charters.

All refunds are processed through the original payment method and may take 5-10 business days to appear in your account.

5. Partner Obligations

As a Partner on AllSail, you agree to:

Provide accurate and truthful descriptions, specifications, and photographs of your boat.
Maintain your boat in a safe, seaworthy condition and comply with all applicable maritime regulations.
Carry valid marine insurance on all listed vessels.
Respond to booking inquiries promptly, ideally within 24 hours.
Honor all confirmed bookings unless there is a genuine safety concern or emergency.
Ensure all listed amenities and extras are available and functional during the charter.
Not solicit Guests to transact outside the Platform.

6. Guest Obligations

As a Guest on AllSail, you agree to:

Provide accurate personal information for the booking.
Treat the boat and equipment with reasonable care and report any damage immediately.
Follow all safety instructions provided by the captain or crew.
Not exceed the maximum number of guests specified in the booking.
Comply with all applicable local maritime laws and regulations.
Not share personal contact information to arrange bookings outside the Platform.

7. Limitation of Liability

AllSail acts as an intermediary marketplace connecting Guests with Partners. AllSail does not own, operate, or control the boats listed on the Platform.

To the maximum extent permitted by applicable law:

AllSail is not liable for any direct, indirect, incidental, special, or consequential damages arising from the use of the Platform or any charter.
AllSail is not responsible for the condition, safety, legality, or suitability of any boat listed on the Platform.
AllSail is not liable for any actions or omissions of Partners, Guests, crew members, or other third parties.
AllSail's total liability shall not exceed the amount of commission earned on the relevant booking.

8. Dispute Resolution

In the event of a dispute between a Guest and a Partner:

Both parties should first attempt to resolve the issue directly through the Platform's messaging system.
If direct resolution is not possible, either party may contact AllSail support to request mediation.
AllSail will review the dispute and may, at its discretion, facilitate a resolution including partial or full refunds.
AllSail's decision in dispute mediation is final and binding on both parties.

9. Intellectual Property

All content on the Platform, including but not limited to text, graphics, logos, icons, images, and software, is the property of AllSail or its content suppliers and is protected by international copyright laws.

By uploading content to the Platform (such as boat photos and descriptions), you grant AllSail a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display such content for the purpose of operating and promoting the Platform.

10. Privacy

Your privacy is important to us. Our collection, use, and protection of your personal data is governed by our Privacy Policy, which forms an integral part of these Terms. Please review our Privacy Policy for detailed information about how we handle your data.

11. Modifications to Terms

AllSail reserves the right to modify these Terms at any time. Material changes will be communicated to Users via email or a prominent notice on the Platform at least 30 days before they take effect.

Your continued use of the Platform after the effective date of any changes constitutes your acceptance of the revised Terms.

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any disputes arising from or relating to these Terms that cannot be resolved through the dispute resolution process described above shall be submitted to the exclusive jurisdiction of the courts of the State of Delaware, United States.
